Purchases made by our users through our website (‘www.vegadeyuco.com’) are governed by the terms and conditions (‘Terms and Conditions’) described below. The purchase of products/services (‘Product/Service’) through www.vegadeyuco.com implies the user’s full and unreserved acceptance of the following terms and conditions of purchase. The Conditions do not cover the purchase of our services/products by third parties outside the Website.

BODEGAS VEGA DE YUCO, S.L. may modify the conditions or offers published on its website (prices, products, promotions, transport rates and other commercial and service conditions) at any time. However, these modifications will not affect purchases already made by our users.

The names and brands of products and manufacturers are used solely for identification purposes. All photos, descriptions and prices are not contractual.

Special offers, promotions, or discounts shall be valid until the date indicated or until the indicated stock runs out. The same applies to the prices indicated at the time of consulting the website.

  1. How can I shop on the website?

The purchase by the user is made and completed by following the purchase procedure described in this section. By making a purchase on our website, you agree that communications with BODEGAS VEGA DE YUCO, S.L. will be mainly by electronic means.

To proceed with purchasing products/services on our website, simply follow these steps:

  1. To make a purchase, you must add the products you are interested in to your ‘shopping basket’.
  2. Once you have filled your basket with all the products you wish to purchase, you can complete your purchase.
  3. To complete your purchase with BODEGAS VEGA DE YUCO, S.L. you must finalise your purchase and proceed to pay for the products purchased via the payment gateway.
  4. The purchase will be finalised when the user receives the order confirmation by email, which will detail the products/services purchased and these terms and conditions.
 

BODEGAS VEGA DE YUCO, S.L., in accordance with current legislation, will not sell alcoholic beverages to persons under the age of eighteen (18) under any circumstances. Therefore, purchases must be made by a person of legal age.

To purchase experiences, you must follow these steps:

  1. In order to make a booking, the user must first select the date and time and enter the promotional code, if available.
  2. The next step is to complete a form with the personal details of the user making the booking, including debit/credit card details.
  3. To complete your booking with BODEGAS VEGA DE YUCO, S.L., you must accept the terms and conditions of purchase, the legal notice, the privacy policy and our cookie policy.
  4. The booking will be finalised once the user receives confirmation. During the service purchase process, the user will be informed of the cancellation policy and details of the experience.
 

BODEGAS VEGA DE YUCO, S.L. In accordance with current legislation, alcoholic beverages will not be served to persons under the age of eighteen (18) under any circumstances; therefore, wine tasting services will not be provided.

  1. Product prices. Taxes and customs duties

The price shown at all times next to our services includes the corresponding indirect taxes. If there is a typographical error in any of the prices shown and if a user has made a purchase decision based on that error, we will notify them of this incident immediately and the user will have the right to cancel their booking at no cost to them.

In the case of products, the price does not include shipping or transport costs, which will be indicated at the time of placing the order.

  1. What are the shipping and transport conditions?

4.a) Where do we deliver?

We ship throughout the Canary Islands, mainland Spain, and some regions of the EU. At BODEGAS VEGA DE YUCO, S.L., we work with Correos, NACEX, MBE Coslada, Sending, MRW, UPS, and CT_express. Within the EU, we use TNT, NACEX, and UPS, as well as other agencies, depending on the destination.

4.b) How long will it take for your order to arrive?

The usual delivery time ranges from 48 to 72 hours from the time the order is processed—on business days—or 3 to 6 days from receipt of confirmation of payment for the order, depending on the shipping method, country, and logistics company used for transport. Orders are processed Monday through Friday from 9:00 a.m. to 12:00 p.m. Shipments to the Canary Islands are sent between islands on Tuesdays and Thursdays before 12:00 noon, so delivery times may vary depending on the day and time of purchase. These shipments are made through the Correos company.

If the item is out of stock and cannot be delivered on time, we will notify you of the estimated delivery time for your order and you may exchange it for another item if you wish, or request a refund.

These delivery times are approximate and BODEGAS VEGA DE YUCO, S.L. reserves the right to delay them for reasons beyond the company’s control. In any case, we will always try to shorten delivery times as much as possible to ensure fast and efficient receipt of orders.

The agreed delivery times for the product are understood to be without prejudice to any delays that may arise due to force majeure.

The services will be provided on the agreed date and time, except in cases of force majeure and upon prior notification to the affected party.

Customers will also be kept informed of the status of their order through the provision of a tracking code and/or specific information about the transport agency that will deliver their order.

4.c) What should I do in the event of a delay or error in shipping, delivery, or service provision?

In the event of a delay, delivery error or lost product, please contact us as soon as possible. BODEGAS VEGA DE YUCO, S.L. will contact the logistics company to initiate an investigation and resolve the incident as soon as possible. We will make every effort within our power and contact the user to provide the best solution. Where appropriate, we will resend any orders that have not been received or have not been delivered in perfect condition, at no additional cost to the customer.

The user shall have the right to terminate the contract and receive a refund for the product and shipping costs if we do not deliver within the agreed period and the conditions set out in Article 66.bis of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, are met.

In the event that we are unable to provide a service or fail to do so under the established conditions, or if there is an unjustified delay for reasons not attributable to the user, the user shall also be entitled to terminate the contract and receive a refund for the agreed service.

4.d) How much are the shipping costs?

The amount of the shipping costs is indicated separately at the time of placing the order and is payable by the user, who must accept them before making payment.

Shipping costs vary depending on the destination and number of bottles.

For shipments within the archipelago, transport costs will be as follows:

  • 1 to 3 bottles: €9
  • From 3 to 6 bottles: €11
  • From 6 to 12 bottles: 13 €
  • + 15 bottles: 15 €
 

The retail price of wines shipped to the Canary Islands is automatically adjusted during the purchase process to include the corresponding tax, with IGIG (Canary Islands General Indirect Tax) applied instead of VAT.

The company reserves the right to modify and update the website prices in accordance with market prices, both for wines and for the transport agencies used to deliver the orders. 

4.e) Where will I receive the order?

The products will be delivered to the address indicated by the user on the order form.

Delivery will be made through the transport companies offered/directly by BODEGAS VEGA DE YUCO, S.L.

If the user is absent at the time of delivery, the transport company will contact the customer to arrange a new delivery or, if necessary, after several failed delivery attempts, will notify the customer by means of a notice to collect the order from the corresponding transport office.

BODEGAS VEGA DE YUCO, S.L. will track the delivery of the order.

  1. Technical means to correct errors in the case of reservations.

If you notice that an error has occurred when entering your booking details, you can modify them in your customer account.

In any case, you may correct errors related to the personal data provided during the booking process by contacting us at bodega@vegadeyuco.com or pedidoweb@ovegadeyuco.com, or by calling 928524316 during customer service hours.

This website displays confirmation windows at various stages of the booking process which prevent you from continuing if the necessary information has not been entered or has not been validated correctly. Unfortunately, we cannot guarantee a booking for which all the necessary information has not been provided. Fields marked with an asterisk (*) or marked as required must be completed.

If you detect an error in your booking after completing the process, you must immediately contact our customer service department on 928524316 or by email at bodega@vegadeyuco.com so that we can try to correct the error as far as possible. 

6 Booking cancellation policy

Cancellation requests notified more than 24 hours prior to the activity will be refunded in full to the purchaser and/or customer. Alternatively, a compensatory voucher may be requested, which can be exchanged exclusively for another identical or similar experience, with an expiry date of 31 December of the current year.

If the cancellation request is made less than 24 hours in advance, no refund will be given. Those
who do not show up on the day and at the time specified for the experience will not be entitled to a refund or a compensatory voucher.

Cancellation requests must be sent to bodega@vegadeyuco.es or vegadeyuco@fincatesteina.com, indicating your full name, date and experience booked, as well as the booking number or voucher number you will have received via email.

If, due to force majeure, Bodegas Vega de Yuco is unable to carry out any of the activities, the purchaser and/or customer will be offered a change of activity, a change of schedule, or a voucher valid for one year or, as a last resort, a full refund of the amount paid.

  1. Payment method

7.a) What payment methods can I use?

Products/services can be paid for by credit/debit card. You may also contact the sales department at Bodegas Vega de Yuco to arrange payment by bank transfer, only in the event that you are unable to make the purchase through the website due to a specific incident and with prior acceptance by Bodegas Vega de Yuco.

  1. What are the invoices like?

The user agrees that invoices for purchases of products/services will be issued electronically and sent by e-mail. You may request a paper copy of the invoice by sending an e-mail to bodega@vegadeyuco.com.

7.a) How long do I have to withdraw from the purchase or decide to return a product?

The user will have a period of fourteen calendar days to decide to return the ‘Product’ from the date of receipt without incurring any penalty or expense, except those corresponding to the return and without the need for justification. The product must be returned in the same condition as it was received.

The withdrawal period shall expire 14 calendar days from the day on which the product is received by the user or an authorised third party.

In the case of personalised services/products, returns will not be possible.

In the case of voucher and experience bookings, refunds will be made in accordance with the service cancellation policy set out in point 6 of these terms and conditions.

7.b) How can I cancel my purchase?

If the user requests to change or cancel a booking made on our website, they must comply with the specific conditions indicated in the booking itself. Please check your booking details to see the specific conditions that apply.

If you wish to return the product or cancel the purchase, you must notify us of your decision to cancel the contract by sending a clear statement by post to BODEGAS VEGA DE YUCO, S.L. at the following address: Camino Del Cabezo, Sn – Masdache, 35572 – Tias, Lanzarote (Las Palmas); or by email to bodega@vegadeyuco.com or pedidosweb@vegadeyuco.com.

You may use the withdrawal form template provided below, although its use is not mandatory. Any communication informing us of your exercise of the right of withdrawal before the expiry of the corresponding period will suffice.

7.c) What are the requirements for exercising the right of withdrawal?

If the user decides to cancel their purchase once the order arrives, they will be responsible for the original shipping costs, if any.

The right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene and have been unsealed after delivery.

If you decide to cancel your booking, you must notify us in advance, at least 24 hours prior to the service being provided.

In the event of withdrawal on your part, we will refund all payments received from you, including shipping costs (if applicable). However, to do so, you must notify us of your intention not to receive the service or to withdraw from the purchase by returning the products or delivering them directly to us, without undue delay and, in any case, no later than 14 calendar days from the date on which you notify us of your decision to withdraw. The withdrawal period shall be deemed to have been complied with if you do not return the goods or do not attend the service and do not notify us of your non-attendance within the specified period.

7.d) How is the refund made?

BODEGAS VEGA DE YUCO, S.L. will refund the amount of the product/service using the same payment method used by you at the time of purchase, unless you have expressly stated otherwise; in any case, you will not incur any expenses as a result of the refund within a maximum period of 14 calendar days from the date on which we are informed of the withdrawal.

If the order has been delivered, we may withhold the refund until we have received the products, or until you provide proof of their return. When returning a ‘Product’, we recommend that you obtain proof of its shipment.

For the product to be returned, it must be unused and retain its original seal or packaging intact. Packaging with any type of sticker, adhesive paper or similar affixed by the user will not be accepted. We reserve the right to refuse a full refund if the returned ‘Product’ has been damaged.

If the return is made because the user considers that the ‘Product’ is defective and wishes to be refunded the amount paid, they also have fourteen working days to return it from the date of receipt of the product. Returns made in this way do not limit the rights to which they may be entitled under the product warranty established by consumer and user regulations.

Products sold by BODEGAS VEGA DE YUCO, S.L. may be returned within 14 calendar days if they are not suitable.

  1. Force majeure

BODEGAS VEGA DE YUCO, S.L.  shall not be liable for any failure or delay in the performance of any of its obligations where such failure or delay is due to events beyond our reasonable control (‘Force Majeure Event’).

Force Majeure shall include any act, event, failure to exercise, omission or accident beyond our reasonable control, such as a) strikes, lockouts or other industrial action; b) civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war; c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster; d) Impossibility of using means of transport; Impossibility of using telecommunications systems; and e) Government acts, regulations or restrictions.

The obligations arising from these conditions shall be suspended during the period of Force Majeure and the deadline for fulfilling said obligations shall be extended for a period equal to the duration of the Force Majeure. We shall use all reasonable means to bring the Force Majeure to an end or find a solution that allows us to fulfil our obligations despite the Force Majeure.

  1. Partial nullity

If any of these Terms and Conditions is declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.

  1. Applicable law and competent courts

Contracts for the purchase of products/services through our Website and any disputes or claims arising from them or relating to their subject matter or conclusion (including non-contractual disputes or claims) shall be governed by Spanish law.

Any dispute arising from or related to the use of the website or the products/services shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals of the province of Las Palmas.

If you are contracting as a consumer, nothing in this clause shall affect your rights as such under current legislation, and you may choose to file a claim to enforce your rights in relation to these Terms and Conditions before the judge or courts corresponding to your place of residence.
